Ted: A privacy policy should outline for site users whether you collect information on the site, and, if you do, what you do to store, share, protect and destroy that information. A privacy policy does not have to be extensive or legalistic, but the key is that your company needs to comply with it, since there are legal penalties for failing to do so. Terms of use can include a privacy policy. Typically, terms refer to what the user is agreeing to when they use the site. You will list your "swimming pool" rules here and reserve the ability to do certain things. Both are very good ideas for your site.
