My company has launched a web app - StartupToDo.com. How specifically do I protect my application's name? Since the site is a subscription-based training site that will soon have a major productivity app component, should it be a trademark or a servicemark or what?

Bob, I like your website. You can submit a registration at USPTO.gov relatively easily, or hire me to do it. I think most of your questions will be answered in the Trademark FAQs in my online book Charles' Primer of Online Media Law. :) Chas

Bob: Sounds like you may have both copyright and trademark issues. Always a good idea to invest in a solid IP attorney who understands both before you put out a product like this. Initial expenses will be far less than the expenses associated with going out without protection.

Bob,

Because you actually have a product (A productivity app) I think you want to have a Trademark and not a service mark. I am not 100% sure about this but I think I am right.

Thanks, Zach
